Regional Note: Lagniappe derives from New World Spanish la ñapa, "the gift," and ultimately from Quechua yapay, "to give more." The word came into the rich Creole dialect mixture of New Orleans and there acquired a French spelling. It is still used in the Gulf states, especially southern Louisiana, to denote a little bonus that a friendly shopkeeper might add to a purchase. By extension, it may mean "an extra or unexpected gift or benefit."

  • October 2012            The Family Court Pilot Mediation Program begins in Judge Mary Devereux's division at the 22nd Judicial District Court.  This innovative program, co-created by Mark Myers, will require families with contested child custody/visitation cases to mediate prior to their court date.  Mark is appointed to the Court's Panel of approved mediators.

  • JUNE 2011       Mark successfully mediates a family succession dispute which had been litigated for more than three years in two different courts.  After three mediation sessions, all issues were resolved.  The parties were so satisfied with the mediation process, they all agreed to bring any future disputes related to the succession property back to Mark in arbitration.

  • MAY 2011          Mark accepts his first arbitration assignment for FINRA in the state of Georgia.  He now provides arbitration services to the Financial Industry Regulatory Authority (dispute resolution services for NASD/NYSE) in seven states:  Louisiana, Texas, Arkansas, Mississippi, Alabama, Tennessee & Georgia.

WHAT'S GOING ON IN THE FIELD OF ALTERNATIVE DISPUTE RESOLUTION ?
  • Revised Discovery Guide and Document Production Lists for FINRA Customer Arbitration Proceedings

    Effective Date: May 16, 2011

    FINRA is revising the Discovery Guide to expand the guidance it gives to parties and arbitrators on the discovery process and to update the Document Production Lists. FINRA is consolidating the Document Production Lists from the 14 current Lists (two general Lists and 12 separate Lists for specific types of claims) to two lists of “presumptively discoverable” documents—one for firms/associated persons to produce and one for customers to produce. Many of the documents on the current Lists are included in the revised Discovery Guide. In addition, under the revised Guide, FINRA is requiring parties to produce additional types of documents that forum users have indicated they need to develop a case.  The amendments are effective on May 16, 2011, and will apply to all customer cases filed on or after the effective date. The amendments to Rules 12506 and 12508 are set forth in  FINRA's revised Discovery Guide and are available on their website at www.finra.org.
